What is Probate?

Probate is a court proceeding designed to distribute the assets of a deceased person to his or her beneficiaries. If someone passes away with a will, the probate court aims to distribute that person's assets to the beneficiaries named in the will. If someone passes away without a will, the probate court distributes that person's assets according to intestacy statutes.

The testator, or the person who drafts a will, almost always names an executor, administrator, or fiduciary to make sure their estate is handled properly. Executors, administrators, and fiduciaries are responsible for opening the estate, settling the outstanding debts of the testator, and distributing the estate assets according to the testator's wishes, among other responsibilities.
